FRC Disciplinary Committee

 

On 23 February 2017 at the High Court, Queen’s Bench Division of The Administrative Court an appeal lodged by Mr Charles Stuart Craig in the matter of Mr Craig v The Farriers Registration Council was heard by Mr Justice Morris.  The judgement of the five (5) grounds of appeal was handed down on 5 April 2017:

 

Ground 1 – Inconsistent findings by the Disciplinary Committee.  Less for Charge 7 where the Appeal succeeds, Ground 1 of the Appeal is rejected.

 

Ground 2 – The findings of the Disciplinary Committee hearing in 2003.  Ground 2 of the Appeal is rejected.

 

Ground 3 – The Appellant (Mr Craig) was an unreliable witness.  Ground 3 of the Appeal is rejected.

 

Ground 4 – Rejection of the evidence of five third party witnesses called by the Appellant.  Ground 4 of the Appeal is rejected.

 

Ground 5 – Sanction.  Ground 5 of the Appeal succeeds and the matter is remitted to the Disciplinary Committee of the FRC.

 

It shall therefore be necessary to reconvene the Disciplinary Committee of the Council to reconsider the issue of sanction.

 

The case remains live and sub-judice rules apply.

 

A hearing of the Disciplinary Committee shall be listed at the earliest date convenient to all parties.
